The aged care sector faces greater challenges as people live longer and require greater levels of care. In June 2012, there were 3.22 million people aged 65 years and over in Australia – 14% of the population, according to the Australian Bureau of Statistics.

The owners and operators of community and residential aged care facilities need careful and considered legal advice to deal with the regulatory regime affecting them. Some of the challenges facing the sector include financial and operational risks, quality of care, and health and safety risks to residents and the workforce.

The Productivity Commission’s report Caring for Older Australians, has been largely adopted by the Commonwealth Government in developing its Living Longer, Living Better reforms. Home and community care (HACC) is by far the largest and most extensive program of support for older Australians, although around two-thirds of government expenditure is directed to residential care.

We support approved aged care providers in managing these changes and challenges by advising on appropriate risk management processes and strategies and on compliance with reporting requirements. We assist aged care organisations with coronial investigations, claims for damages and complaints to the Aged Care Commissioner.
