Employment

Our experienced lawyers help you deal with employment law changes and challenges to keep your business on track.

Australian employment law has undergone significant change over the past decade, from the attempt to unify industrial relations under the federal umbrella in 2005, to the creation of the Fair Work Commission, including the National Employment Standards and the complex laws regulating enterprise bargaining and industrial disputes.

Our dedicated employment law team represents a broad client base, including medical defence organisations, insurers, professional associations and other member organisations. We also act for a large number of corporations and medium and small business operators.

Our employment law services include advising on:

  • contractual issues, leave entitlements, termination of employment, adverse action, redundancy, performance management, managing injured or ill employees, maternity leave, workplace surveillance, workplace policies and procedures;
  • discrimination, harassment and bullying including litigation and the investigation of complaints;
  • confidentiality and protection of intellectual property obligations;
  • enforcement of employee obligations, including drafting post-employment restraints;
  • labour hire and independent contract issues;
  • industrial disputes and union rights of entry across various industries;
  • occupational health and safety;
  • coronial inquests;
  • workplace social media issues;
  • employment/contractor litigation (in the respective federal and State Industrial Relations Commissions);
  • drafting and negotiating employment and contractor agreements, including executive options and bonus schemes and enterprise agreements;
  • employment issues that arise in the sale or purchase of a business, including conducting due diligence and providing strategic advice on obligations to employees;
  • insolvency – employment issues during the administration or liquidation of a business; and
  • advising on modern awards including acting for health professional associations and businesses in applications to the Fair Work Commission to vary the terms of modern awards.
